Welcome to your subscription provided by FEAST Marketing ("Company", "we", "our", or "us"). By accessing or using FEAST Services, Platforms, or Software, you agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By subscribing, you confirm that you are at least 18 years old and agree to these legally binding Terms.
2. Subscription & Billing
2.1 Plans and Pricing
FEAST operates on a monthly or annual subscription model. Base pricing is displayed at checkout and may vary based on selected features and usage.
2.2 Usage Charges
Your subscription may incur usage-based (metered) charges beyond your base plan. These may include, but are not limited to:
Text Messaging (SMS/MMS-Inbound/Outbound):
Charges are applied per message sent or received. MMS (Multi-media messages) may incur higher fees than SMS. Rates vary by carrier and country.
Phone Calls (Inbound/Outbound):
Per-minute charges apply for calls made from or to the platform and/or call tracking numbers. Voicemail and call recording may also have small storage-based fees.
A2P 10DLC Registration Fee:
In compliance with U.S. carrier regulations, all numbers used for SMS/MMS messaging to U.S. recipients must be registered for A2P 10DLC. This registration incurs a monthly carrier fee (set by mobile carriers) that will be billed to your account.
Government and Carrier Taxes:
Federal, state, and carrier-imposed taxes or surcharges may apply to your phone number usage and messaging services. These are in addition to your base subscription and usage charges.
Email Usage:
Emails may incur per-email charges.
Phone Numbers:
Each local or toll-free number added to your account may carry a monthly fee.
AI Tools or Add-Ons:
Charges may apply for use of AI-based features, advanced automations, or third-party integrations, depending on your selected features.
Note: All usage-based charges are billed monthly in arrears (i.e., after usage). You will see these charges itemized in your account.
2.3 Payment Method
You authorize FEAST Marketing to charge your selected payment method for all recurring and usage-based charges. Failed payments may result in suspension or cancellation.
3. Account Responsibilities
You're responsible for managing your account, including login credentials, authorized users, and content shared through the platform.
4. Fair Use & Abuse Prevention
To maintain service integrity for all users:
Excessive usage or abuse of messaging/calling services may result in temporary throttling or review.
Spamming or sending unsolicited messages is strictly prohibited and may result in account suspension without refund.
5. Cancellation & Refunds
5.1 Cancellation
You may cancel your subscription at any time from your dashboard. Your access remains active until the end of your current billing cycle.
5.2 Refund Policy
All payments are non-refundable, including monthly subscriptions and usage-based charges. No partial refunds will be issued for unused services.
6. Intellectual Property
FEAST Engine and all related software, designs, and content are owned exclusively by FEAST Marketing. You are granted a limited license for use under these Terms.
7. Service Availability
While we aim for 99.9% uptime, service interruptions may occasionally occur for maintenance or unexpected issues. We are not liable for temporary disruptions.
8. Marketing Use of Client Name & Logo
By agreeing to these Terms, you grant FEAST Marketing a non-exclusive, royalty-free, worldwide license to use your restaurant’s name, logo, and publicly available branding materials for:
Marketing and promotional purposes
Case studies, testimonials, and portfolio displays
Demonstrations of the FEAST Engine’s capabilities to potential clients
This license is limited to promoting FEAST Marketing and will not be transferred or sold to third parties without your written consent.
9. Modifications
We may update pricing, features, or these Terms at any time. Continued use of the platform constitutes acceptance of any updates.
10. Limitation of Liability
FEAST Marketing is not liable for indirect or consequential damages arising from use of the platform, including lost revenue or data.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States of America. Disputes will be resolved under the exclusive jurisdiction of the state or federal courts located in Wilmington, Delaware.
